Can I File ITR If My PAN Is Inoperative Due to Aadhaar?

I’m trying to file my income tax return for AY 2026–27, but I recently discovered that my PAN is showing as “inoperative.”

I’m an Indian citizen living in Canada and have been filing Indian ITRs because I have income from India. I didn't realize that my PAN-Aadhaar status could affect my return because I don't have an Aadhaar card.

When I logged into the Income Tax e-Filing portal, I saw the warning about my PAN being inoperative. I’m now confused about whether I can still submit my ITR.

My main questions are:

  • Can I file an ITR while my PAN is inoperative?
  • Will the Income Tax Department accept the return?
  • What happens if I am entitled to a TDS refund?
  • Will my refund be blocked because the PAN is inoperative?
  • As an NRI, am I actually required to link Aadhaar with PAN?
  • If I am exempt from Aadhaar-PAN linking because I’m a non-resident, how do I get my PAN status corrected?
  • Do I have to pay the ₹1,000 Aadhaar-PAN linking fee even if I am an NRI?
  • Could an inoperative PAN affect my TDS credit or tax filing?

I’ve seen older discussions saying that an inoperative PAN causes problems with refunds, but I’m not sure whether that means the ITR itself cannot be filed or whether only the refund is affected.

Has anyone recently filed an ITR with an inoperative PAN, particularly an NRI without Aadhaar?

    I would check three things before doing anything:

    1. Your tax residency status

    Make sure you actually qualify as a non-resident for the relevant assessment year. Simply living abroad doesn't mean every person automatically gets every NRI exemption.

    2. Your PAN status

    Check the e-Filing portal to confirm that the PAN is actually showing as inoperative.

    3. Whether you are expecting a refund

    This is important because the Income Tax Department currently states that a refund cannot be issued while the PAN remains inoperative.

    If you're an eligible NRI who is exempt from Aadhaar-PAN linking, I wouldn't pay the ₹1,000 fee just because an online article tells you to. The CBDT's guidance says the consequences of an inoperative PAN don't apply to persons who are exempt from the Aadhaar requirement.

    I'd get the exemption/status issue resolved through the official portal rather than trying to work around it.

    I'm an NRI in the UK and had a similar concern.

    One thing that confused me was that the portal showed my PAN as inoperative, even though I don't have Aadhaar. I initially assumed I had to get Aadhaar just to make my PAN active.

    That's not necessarily the case for an eligible non-resident.

    The Aadhaar-PAN rules have exemptions, and non-residents can fall within the exempt category. So if you're genuinely a non-resident under the applicable income-tax rules, don't automatically assume that you need to link Aadhaar.

    I would first check the current Income Tax Department instructions for the exemption and then contact the e-filing/PAN support channel if your PAN status hasn't been updated correctly.

    Also, if you're filing because TDS was deducted in India, don't leave the return until the last minute. The Department's current guidance makes it clear that an inoperative PAN can prevent a refund from being issued.

    The important distinction seems to be filing the return versus receiving the refund.

    I haven't had the exact NRI situation, but I had an inoperative PAN because I hadn't linked Aadhaar.

    From what I found on the Income Tax portal, an inoperative PAN does not necessarily mean that you cannot submit an ITR. The bigger issue is the refund.

    The Income Tax Department's current ITR-status guidance specifically says that if the PAN is inoperative, a refund cannot be issued and advises linking PAN with Aadhaar after paying the applicable fee.

    So I wouldn't interpret “PAN is inoperative” as simply “you can't file a return.”

    If you're expecting a refund because of TDS, that's the part I'd be concerned about.

    In your case, though, there's an important difference because you're an NRI. The Department's guidance on consequences of an inoperative PAN says the consequences don't apply to people who are exempt from Aadhaar intimation under the relevant provisions.

    I'd first establish whether you are actually covered by the NRI exemption rather than paying the linking fee automatically.
