I'm currently working in Bengaluru and I'm getting ready to file my Income Tax Return (ITR) for FY 2025–26. My employer has informed us that Form 16 will be issued later than usual this year, but I'd prefer not to wait until the last minute if I can avoid it.
I logged into the Income Tax e-Filing portal and downloaded my AIS and Form 26AS. I can also access my monthly salary slips and bank statements, so most of my income details are available. However, I'm unsure whether it's safe to file my return before receiving Form 16.
My salary is my primary source of income, and I don't have any business income. I also claimed deductions under Section 80C and paid health insurance premiums under Section 80D.
I had a slightly different experience.
My employer corrected some payroll entries just before issuing Form 16, which changed the final taxable salary slightly. Luckily, I hadn't filed my return yet.
That experience made me more cautious. If your employer has already told you Form 16 will be issued soon, waiting a few extra days could save you from having to file a revised return later if anything changes.
Of course, if there's a long delay and you're confident your records are complete, many people do file using the available tax documents instead.
I filed without Form 16 last year because my employer delayed issuing it.
I used my salary slips, Form 26AS, AIS, and the annual salary statement from our HR portal. Before filing, I made sure the TDS deducted every month matched what appeared in Form 26AS.
When I finally received Form 16 a couple of weeks later, I compared it with my return. Fortunately, everything matched, so I didn't need to revise my ITR.
If you decide to file before receiving Form 16, I'd suggest checking your salary figures and deductions carefully because you'll be relying on your own calculations.

I'm an NRI working in the UAE with rental income in India, and I don't receive Form 16 because I don't have an Indian employer.
Every year I prepare my return using AIS, Form 26AS, interest certificates, rental records, and bank statements. It's taken a bit more effort, but it has worked well so far.
From my experience, Form 16 is a useful summary issued by an employer, but it's not the only source of information for filing an ITR. The important part is making sure all your income, TDS, and deductions are reported accurately.
Requirements can vary depending on your income sources, so the documents you'll need may differ from someone with only salary income.
