I have been living and working in Dubai for several years and recently received an income tax notice in India related to a property I own there. I am confused because I thought my salary earned in Dubai would not be taxable in India as long as I qualified as an NRI.
The property is in India, and I have received rental income from it. Some of the rent was deposited into my NRO account, but I am not sure whether the tenant deducted the correct TDS or whether I was supposed to file an income tax return separately.
I am also worried that the notice might be connected to the money I transferred from Dubai to India to purchase or maintain the property. I have bank statements showing the transfers, but I do not know which documents the tax department expects.
Has anyone living in Dubai dealt with a similar income tax notice for Indian property income? What should I check first, and how can I respond without missing the deadline?
I would appreciate guidance on checking the notice, reviewing TDS details and understanding whether my rental income or overseas remittances could be the reason for the query.
If the notice concerns the money you transferred from Dubai to purchase the property, gather evidence showing the source and movement of those funds.
Useful documents may include Dubai salary slips or employment records, overseas bank statements, Indian bank statements, remittance confirmations and the property purchase agreement. The aim is to establish a clear trail from your overseas earnings or savings to the payment made for the property.
A transfer from your own overseas account is not automatically taxable income simply because the money entered India. However, you may still need to substantiate the source if the department raises a question about an investment or deposit.
I would also separate the property purchase issue from the rental-income issue. They can involve different tax questions, and evidence explaining the purchase does not automatically resolve an outstanding tax liability on rent.
If the notice proposes an addition to your income or alleges an unexplained investment, consult a chartered accountant experienced in NRI taxation before submitting the response.
First, check the exact type of notice you received. An income tax notice about rental income is different from a notice asking you to explain the source of funds used to purchase a property.
If the property is in India, the rental income is generally taxable in India even if you live and work in Dubai. Your Indian tax residential status does not automatically exempt income arising from Indian property.
Log in to the official Income Tax Department e-filing portal directly and check the notice under the relevant section or proceedings. Verify the assessment year, the reason for the notice, the response deadline and any information the department has requested.
Keep your rental agreement, rent receipts or bank credits, municipal tax receipts and home-loan interest details, if applicable. You should also check Form 26AS and your Annual Information Statement (AIS) to see whether the rent and TDS details match your records.
I would not ignore the notice or send a generic response. The right explanation depends on what the department is actually questioning.

Check whether your tenant deducted TDS correctly. Rent paid to a non-resident landlord is generally subject to TDS under the applicable provisions, and the withholding may be higher than the landlord’s final tax liability.
If excess TDS was deducted, you may be able to claim a refund by filing the appropriate income tax return, provided you meet the applicable requirements. If the tenant failed to deduct or deposit TDS, that may need separate attention.
Also, do not assume that every Dubai-based Indian citizen is automatically a non-resident for Indian tax purposes. Residential status is determined under Indian tax rules for each relevant year, including applicable stay and other conditions.
I would prepare a year-by-year summary of rent received, allowable deductions, TDS deducted and other Indian income. Compare it with the information in the notice and the tax portal before responding.
