I work in the Merchant Navy and have been trying to understand whether my salary is tax-free in India. I’ve heard from other seafarers that if we spend enough days outside India and qualify as non-residents, our foreign-ship salary may not be taxable in India.
However, I’m confused about how the rules work. Does it depend on the number of days spent in India, the country where the ship is registered, or the bank account where the salary is credited?
I also want to know whether the same rules apply to everyone working in the Merchant Navy or whether officers and crew members have different tax treatment.
Pay close attention to the number of days you spend in India during each tax year. Under the current residency rules, the general test includes a stay of 182 days or more, while additional conditions and exceptions may apply. Indian citizens leaving for employment abroad or serving as crew members of Indian ships have specific provisions.
It is better to calculate your stay using actual travel dates rather than estimating from the number of months you were onboard. Also, don’t assume that spending fewer than 182 days in India automatically settles every tax question; your circumstances and the applicable residency tests still need to be checked.
Merchant Navy salary is not automatically tax-free. The main factors are your residential status under Indian tax law and where the income is considered to have accrued or been received.
The Income Tax Department has clarified that salary earned by a non-resident seafarer for services performed outside India on a foreign-going ship is not taxable merely because it is credited to an NRE account in India. However, you should not assume the same outcome applies to every employment arrangement.
Keep a record of your sign-on and sign-off dates, passport immigration stamps, CDC entries, employment contract and salary statements. These records can help establish your sailing periods and support your tax position if questions arise.

Even if your Merchant Navy salary is not taxable in India, check whether you have other Indian income, such as NRO account interest, rental income or capital gains. Those income sources may have separate tax treatment.
You should also check whether filing an income tax return is required in your circumstances. Keep your salary records and supporting travel documents, and consult a chartered accountant who regularly handles seafarer taxation if you are unsure about your status.
