Who Must File a Partnership Tax Return?

The partnership form must be filed by the following: 

  • This Form should be filed by the domestic partnerships that the IRS mentioned as a relationship between two or more persons to start a business by contributing money, property, and their skills and shares equally or profit and loss from the business, even if they had a formal agreement or not. 
  • LLC, which is considered a partnership for tax purposes. 
  • It can be filed by the apostolic organizations and non-profit religious organizations 501(d). 
  • Foreign partnerships that have income generated from foreign sources.

    Partnerships and LLCs that pass through entities and have any profits or losses directly to the LLC members or partners need to report their taxes on the shared income and use the Schedule K-1 and file form with their personal tax return, IRS Form 1040.

      Partnerships need to file their information return on Form 1065, which is a U.S. return of partnership income.

      Yes, both the corporation and partnership need to file the tax return even if they don't have any income generated in that year.
