Yes, NRIs can do Business in India, as approved by the government of India, and foreign nationals to make investments in India to attract foreign direct investments (FDI) under the Foreign Exchange Management Act, 1999 (FEMA) regulations. For an NRI, a private limited company can have up to 200 shareholders, and a public limited company can have an indefinite number of shareholders.

    For an NRI to start a business in India, the NRI has to complete the company registration in India by following the process given below. 

    • NRI and foreign national directors need to get a DSC. 
    • NRI and foreign national directors need to get a DIN. 
    • NRI must have completed registration on the MCA (Ministry of Corporate Affairs) and filing of SPICe+ Form. 
    • They need to upload all the company documents, like e-MoA and e-AoA. 

    After the verification of documents and the application, the registrar will issue the registration certificate.
